Mission Tasks

To address all aspects related to the Contract with the Client under the guidance of the Project Director / Manager during the execution phase, as well as related to joint venture agreements, with the objective of maximising Project revenues and reducing the risk in the face of potential disputes raised as the consequence of particular contractual conditions.

 

Professional Skills

1) Advises the Project Director / Manager on any aspect of the Project execution which deviates from the requirements of the Contract. 2) Liaises with Corporate Legal department concerning potential serious disputes with the Client. 3) Initiate change orders request procedure and prepares and coordinates any claims against the Client in the case of non-resolved disputes working out change or claims amounts and schedule impact, keeping all records and files related to these items. 4) Administrates all contractual correspondence between Client and Contractor and between joint venture/consortium partners. 5) Establishes the milestones completion notices, collects the necessary back up to allow preparation of change order request, to seek for Client approval of day-rate variation and initiate additional cash calls to Administration function with this documentation. 6) Collects adequate files and register of all Bonds and Guarantees ensuring in liaison with Administration function that such bonds and guarantees are issued and returned / discharged 7) Ensures in liaison with competent Corporate functions that required insurance coverage is timely put in place and that required insured certificates are provided. 8) Assists the Project Director / Manager whenever an event which may give raise to the issue of a precautionary Notice of Accident in accordance with the provisions of the Contract and/or of the Policy, occurs. Subsequently follows-on the evolution of the event, providing support for the orderly build-up of the documentary evidence to be used to substantiate the Insurance Claim. 9) Solicits or ensures notification and submission of requests and notices, documents, in particular for those subject to time limits. 10) Provides a para-legal assistance to the Project Team, and interfaces with the BU’s designated Corporate Manager, and with the Legal and Contracts Departments (at Corporate level or in the Area, if available) for any legal/contractual issue. Also provides the Legal Department, under the guidance of the Project Director / Manager, with all information and Project documents required in case of Legal Proceeding or Arbitrate. 11) Provides assistance to the Project Director / Manager in the management of the legal \ contractual aspects of JV \ consortium agreements leading any consequent issue pertaining to claims \ litigations among the parties. 12) Makes a preliminary check of sub-contracting plan and gives indications to subcontracting \ procurement department prior the stipulation of the subcontract for transfering risks to Subcontractors. 13) Assists subcontracting \ procurement department in the management of contract related correspondence and in the management of claims \ litigations with subcontractors. 14) Provide support, when required, to the Proposal/Project Manager in reviewing the contractual documentation and qualifications and notes.
